Privacy and cookies policy

We respect the right to privacy and protection of personal data of the Users of our website and online shop available at https://www.hedonista.com/ (hereinafter referred to as: the Website). This Privacy Policy sets out the principles on which we collect and process personal data of our Users, , including information referred to in Article 13 of Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC.

 

§ 1. Personal data

In accordance with the definition set out in Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation), hereinafter referred to as the GDPR, ‘personal data’ means any information relating to an identified or identifiable natural person (‘data subject’); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.

§ 3. Collection of personal data

Personal data is collected by us in particular during the process of:
1) subscribing to the newsletter;
2) setting up an account on the Website;
3) conducting e-mail correspondence
4) conversations via the Customer Service hotline

§ 5. Purpose and basis of personal data collection

1. Personal data collected when subscribing to the newsletter is collected for the purpose of conducting marketing activities towards Users, including for analytical and statistical purposes. (Article 6(1)(A) RODO).

2. Personal data collected when setting up an account on the Website is processed for the purpose of:
• concluding and implementing a contract for the provision of electronic services, i.e. enabling the User to use our Website (art. 6 ust. 1 lit. B RODO);
• concluding and implementing a contract of sale (distance), the subject of which are goods available in our online shop (Article 6(1)(B) RODO);
• investigating and examining complaints that may be made in connection with the purchase of goods in our online shop (Article 6(1)(F) RODO);
• asserting or defending against claims arising as a result of the conclusion of the aforementioned contracts (Article 6(1)(A) RODO);
• marketing of products and services, including for analytical and statistical purposes;
• contacting Users, including for purposes related to permitted marketing activities, through available channels of communication, in particular and with the consent of Users – by e-mail and telephone (Article 6(1)(A) RODO);
• fulfillment by the Administrator of obligations imposed by law, in particular accounting and tax laws (Article 6(1)(C) RODO).

3. Personal data collected when placing orders is processed for the purpose of:
• concluding and implementing a contract for the provision of electronic services, i.e. enabling the User to use our Website (Article 6(1)(B) RODO);;
• concluding and implementing a contract of sale (distance), the subject of which are goods available in our online shop (Article 6(1)(B) RODO);
• investigating and examining complaints that may be made in connection with the purchase of goods in our shop (Article 6(1)(F) RODO);
• asserting or defending against claims arising as a result of the conclusion of the aforementioned contracts (Article 6(1)(F) RODO);
• marketing of products and services, including for analytical and statistical purposes (Article 6(1)(A) RODO);
• contacting Users, including for purposes related to permitted marketing activities, through available channels of communication, in particular and with the consent of Users – by e-mail and telephone;
• fulfillment by the Administrator of obligations imposed by law, in particular accounting and tax laws (Article 6(1)(C) RODO).

5. Personal data collected in the course of email correspondence shall be processed for the purposes of that correspondence, which may be related in particular to:
• performance of a contract or taking action at the request of the data subject prior to entering into a contract (Art. 6(1)(B) RODO);
• taking steps to negotiate or establish a relationship (Art. 6(1)(F) RODO);
• recruitment (Art. 6(1)(A) RODO);
• providing assistance to an email contact, in particular responding to a submitted inquiry and providing prompt customer support in accordance with their expectations (Article 6(1)(F) RODO)
• to process a complaint reported via email correspondence (Article 6(1)(F) RODO);
• filing claims (Article 6(1)(F) RODO).

6. Personal data collected via the Customer Service hotline are collected for the purposes for which the data subject reports to the Customer Service, in particular:
• perform a contract or take action at the request of the data subject prior to entering into a contract (Art. 6(1)(B) RODO);
• recruitment (art. 6(1)(A) RODO)
• to provide assistance to an email contact, in particular to respond to a submitted inquiry and to provide prompt customer support in accordance with their expectations (Article 6(1)(F) RODO)
• to process a complaint reported via hotline correspondence (Article 6(1)(F) RODO);
• report claims (Article 6(1)(F) RODO).

 

§ 6. Data storage period

Personal data will be stored for the period:
• Contract performance and statute of limitations - in the case of data processed for contract performance, claim filing, defense against claims, and data processed for accounting purposes;
• Until the withdrawal of consent - in the case of data processed on the basis of consent (e.g., data collected for marketing purposes, for recruitment purposes);
• Until an objection is raised - when data is processed on the basis of the legitimate interest of the Administrator, i.e. Article 6(1)(F) RODO;
• Until the purpose is achieved - in the case of data processed for recruitment purposes, in the case of email correspondence or hotline consultations.

 

§ 7. Entrustment of processing and Sharing of personal data

1.The Users' personal data collected by us may be transferred on the basis of an agreement on entrustment of data processing to entities supporting us in the conclusion and execution of contracts and performance of activities referred to above, as well as in the investigation or defense against claims, in the performance of obligations under the law, and also supporting us in the provision of marketing services, including in particular: entities providing consulting, advisory, auditing, legal, tax, accounting assistance, research agencies acting on our behalf, the Polish Post, carriers, courier companies, entities handling electronic or payment card payments - when choosing this type of payment, IT service providers, marketing agencies, as well as entities related to us personally or by capital and our business partners.
2. With your consent, your personal data may be shared with our affiliates and our business partners for the purpose of direct marketing of their products and services.

 

§ 8. Profiling

With the User's consent, the User's personal data may be processed by HEDONISTA headquartered in Łódź. Administrator in an automated manner including alsȯ in the form of profiling - in order to analyze or forecast personal preferences and interestś of the User, and to provide personalized offer.

 

§ 9. Rights of Users related to data processing

The User shall have the right to access his/her data and the right to request rectification, erasure or restriction of their processing.
To the extent that the basis for personal data processing is the performance of the contract or the User's consent - the User has the right to transfer the provided personal data to another administrator.
To the extent that the basis for data processing is the legitimate interest of the Administrator - the User has the right at any time to object to the processing of his/her personal data.
To the extent that the basis for data processing is the User's consent - the User has the right at any time to withdraw consent to the processing of personal data at any time without affecting the legality of the processing that was performed on the basis of consent before its withdrawal.
In order to exercise the rights referred to in Paragraphs 1-43, the User shall contact the Data Protection Officer designated by the Administrator by e-mail at gdpr@hedonista.com in § 11 or by letter to the Administrator's registered office address indicated above.
The User shall also have the right to lodge a complaint to the supervisory authority dealing with personal data protection.

 

§ 10. Information about the intention to transfer personal data to a third country or international organization

The Administrator does not transfer Users' personal data to a third country or international organization In case of the intention to transfer Users' personal data outside the EEA, before Users' personal data is transferred outside the EEA, the Administrator will make every effort to ensure that such transfer does not lead to a lowering of the level of protection guaranteed under the laws in force in countries belonging to the EEA. If personal data is transferred outside the EEA, the transfer will be based on standard data protection clauses adopted by the European Commission. Users may request additional information regarding the transfer of data outside the EEA and obtain a copy of the adopted protection measures by contacting the Administrator.

 

§ 11. Information on the requirement to provide Personal Data

Provision of Data is, in principle, voluntary, however, it is a requirement for entering into a contract with the Administrator, receiving commercial information, conducting e-mail correspondence or conducting a call via the hotline. Failure to provide personal data during the account registration procedure will prevent the User from creating an account. Failure to provide personal data when placing an order will prevent the User from placing an order and concluding a sales contract. Failure to provide data when signing up for the newsletter will prevent the User from receiving commercial information. Failure to provide data when corresponding by e-mail or during a conversation with a Customer Service employee on the hotline will make it impossible to deal with the matter with which the data subject has applied. In the case of concluding a sales contract, providing data is mandatory due to tax and accounting obligations.

 

§ 12. Data Protection Inspector

The Administrator has appointed a Data Protection Officer (DPO), responsible for ensuring compliance with the provisions of the RODO, providing recommendations on data protection impact assessments, as well as cooperation with the supervisory authority.

§ 13. Obligation to keep the Data confidential and secure

The Administrator undertakes to maintain confidentiality related to Personal Data and their proper protection.

 

§ 14. Cookies

Cookies (cookies) are small text information in the form of text files, sent by the server and stored on the end device of Users visiting the website https://www.hedonista.com/ (e.g. on the hard drive of a computer, laptop, or on the memory card of a smartphone - depending on the device used by the User).

On the website https://www.hedonista.com/ we use our own cookies: session cookies and permanent cookies. Proprietary cookies are used for: maintaining the shopping cart and the User's session; remembering the language version and the country of delivery; remembering the reference code (where the customer came to us from); remembering the data entered in the order form - form of delivery and payment, delivery address and billing address; remembering the User's preferences, e.g. sorting settings, whether to show him/her some messages again, etc.

We also use external cookies from entities we cooperate with, such as Google, Facebook. Due to the fact that the way some cookies from third-party partners work may be different from what is presented in this policy, and we cannot control the cookies posted by third-party sites, please refer to the information on these cookies available on the websites of our partners, e.g. Google: https://www.google.pl/intl/pl/policies/technologies/cookies/ and Terms of Use of Google Analytics Facebook: http://www.facebook.com/help/cookies [p1].

We also use Tracking pixels (a.k.a. web bugs), which perform a similar function to cookies, but are unrecognizable to the user. Tracking pixels are used by us to measure a user's behavior on the site, to send newsletters, and to tailor offers in remarketing advertising. The data is anonymous and is not linked to personal data on the User's terminal device or any database. In order to disable the web bug while using our website, you can use tools such as webwasher, bugnosys or AdBlock (for Firefox browser). In order to disable the web bug in a newsletter, you need to change the settings of your email program so that it does not display messages in html. The web bug also does not work when messages are read offline.
